DOE Comment Period Extended: Residential Furnaces, Commerical Water Heaters

CodeWatcher Doe Furnace water heater standards

DOE has extended the comment period on the petition for rulemaking and request for comment for energy conservation standards for residential furnaces and commercial water heaters.

On November 1, 2018, the U.S. Department of Energy (“DOE”) published in the Federal Register a notice of petition for rulemaking and request for comment regarding whether DOE should issue an interpretive rule stating that DOE’s proposed energy conservation standards for residential furnaces and commercial water heaters would result in the unavailability of “performance characteristics” within the meaning of the Energy Policy and Conservation Act of 1975, as amended, and withdraw its proposals for amended standards for those products/equipment based upon such findings.

In the intervening period, DOE received two requests from interested parties seeking an extension of the comment period in order to develop additional data relevant to the petition. DOE has now issued a pre-publication notice announcing an extension of the public comment period for submitting comments.

  • The comment period has been extended by 30 days. DOE request and will accept comments in response to the notice of petition for rulemaking until March 1, 2019.
  • Interested persons are encouraged to submit comments using the Federal eRulemaking Portal at Alternatively, interested persons may submit comments, identified by docket number EERE-2018-BT-STD-0018, by Email (, postal mail, or hand delivery/courier.
  • Find product information for Residential Furnaces and Commercial Water Heating Equipment that are the subject of the RFI including current standards and test procedures; statutory authority; waivers, exceptions and contact information
  • DOE welcomes written comments from the public on any subject within the scope of this document (including topics not raised in this request for information).
